These Terms & Conditions (“Terms”) govern access to and use of HappyVolts websites, mobile applications, products, and services.

1. Acceptance of Terms

By accessing or using the Website, Apps, or Services, you agree to these Terms. If you do not agree, do not use the Website, Apps, or Services.

2. Services Covered

HappyVolts provides:

  • A) All-in-one inverter battery systems for backup and solar energy
  • B) Software and embedded software for energy management and monitoring
  • C) Scooter fleet management and ride services via software

Mobile Apps include:

  • HappyVolts E-Mobility (iOS/Android)
  • HappyVolts All-In-One (iOS/Android)

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) and capable of forming a binding contract.

4. Accounts

You may be required to create an account to use certain features. You agree to provide accurate information and keep it updated. You are responsible for maintaining confidentiality of login credentials and for all activity under your account.

5. Acceptable Use

You agree not to:

  • Access, use, or interfere with the Services in an unlawful or unauthorized manner
  • Attempt unauthorized access to systems, accounts, or data
  • Reverse engineer, decompile, or bypass technical restrictions except where legally permitted
  • Upload malware or misuse APIs
  • Use the Services to harass, stalk, or violate the rights of others
  • Misuse location, telemetry, or media to invade privacy or violate applicable law

6. Location, Background Location, and Geofencing (E-Mobility)

E-Mobility features may require precise location, background location access, and geofencing to operate fleet management, safety, service zone enforcement, and recovery features. If you disable location permissions, features may be limited or unavailable.

7. Camera and Photos/Media

Certain features may require camera access and photos/media uploads (for example: condition documentation, issue reporting, verification, and support workflows). You are responsible for ensuring you have the right to upload any media you provide.

8. Payments; In-App Purchases

8.1 In-App Purchases for Scooter Rides

Scooter rides may be purchased using Apple In-App Purchase and/or Google Play Billing. Your purchase is also subject to Apple/Google payment terms and policies.

8.2 Other Payments

Where offered, some services may be paid through Stripe or other payment methods described at the time of purchase. You authorize charges according to the displayed pricing and applicable order terms.

9. No Refund Policy; Warranty Controls for Defect Remedies

As a general policy, HappyVolts does not offer refunds or returns except where required by law or expressly provided in a written warranty or written order form/statement of work.

For covered manufacturing defects of certain battery storage products, HappyVolts’ written limited warranty provides the specific remedies, which may include (at HappyVolts’ discretion) repair, replacement, or a prorated refund based on remaining months in the 5-year warranty period.

Warranty Reference (Battery Only):
“HAPPYVOLTS INC. – LIMITED WARRANTY AGREEMENT (BATTERY ONLY)” covering model numbers beginning with ESS2600V0 and ESS5300V0, for five (5) years from installation, subject to eligibility requirements (including certified professional installation, registration, and internet connection for firmware/diagnostics) and exclusions.

10. Intellectual Property; License

The Website, Apps, firmware/software, content, trademarks, and related intellectual property are owned by HappyVolts or licensors and are protected by law. Subject to these Terms, HappyVolts grants you a limited, non-exclusive, non-transferable, revocable license to use the Apps and Services for their intended purposes.

Your use of the Services is subject to our Privacy Policy:

12. Disclaimers

To the maximum extent permitted by law, the Website, Apps, and Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, except as expressly set forth in an applicable written warranty.

13. Limitation of Liability

To the maximum extent permitted by law:

  • HappyVolts is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business.
  • HappyVolts’ total liability for any claim related to the Services will not exceed the amount you paid to HappyVolts for the specific product/service giving rise to the claim in the twelve (12) months preceding the event (or USD $100 if you paid nothing), unless law requires otherwise.

14. Indemnification

You agree to indemnify and hold harmless HappyVolts from claims arising out of your misuse of the Services, violation of these Terms, violation of law, or infringement of third-party rights.

15. Suspension and Termination

HappyVolts may suspend or terminate access if you violate these Terms, pose a security risk, or for legal compliance. You may stop using the Services at any time. Sections that should survive (including IP, disclaimers, limitation of liability, and dispute provisions) survive termination.

16. Account Deletion Requests

Account deletion requests are handled via email at privacy@happyvolts.com. We may require verification before processing. Personal data will be deleted or de-identified subject to legal, security, warranty, and accounting obligations. Energy consumption/operational history may be retained in a non-personally identifying form where feasible or as needed for compliance and system integrity.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

18. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted at:
